No general permit for data centers

Ohio EPA announced on July 21, 2026 that they will not issue a NPDES General Permit for data centers. This is good news for data center opponents because it means that proposed data centers will have to apply for site specific permits for their wastewater discharges, and residents will have an opportunity to weigh in on the terms of those permits.

The Ohio EPA announcement attributes their decision not to issue a General Permit to “the significant volume of public comments.” We’ve been heard!
